Welcome to AMHG Works LLC. These Terms of Use govern your access to and use of our online services, including any content, features, functionality, communications, and purchases offered by AMHG Works LLC.
By accessing or using our online services, placing an order, or otherwise interacting with AMHG Works LLC, you agree to be bound by these Terms of Use. If you do not agree to these Terms, do not use our online services.
1. Eligibility
By using our online services, you represent that you are at least the age of majority in your state of residence and are legally capable of entering into a binding agreement.
If you use our services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.
2. Changes to These Terms
We reserve the right to update, revise, or modify these Terms of Use at any time without prior notice. Any changes become effective upon posting with an updated effective date. Your continued use of our services after any such changes constitutes your acceptance of the revised Terms.
3. Product Information and Availability
We make reasonable efforts to ensure that product descriptions, pricing, images, dimensions, materials, availability, and other product-related information are accurate. However, errors, omissions, delays, and inaccuracies may occur.
We reserve the right to:
- correct errors, inaccuracies, or omissions
- update product information at any time
- modify or discontinue products without notice
- limit quantities available for purchase
- refuse or cancel orders when necessary
Products may be available only in limited quantities, especially where items are handmade, artisan-produced, seasonal, or made in small batches.
4. Handmade and Natural Variation
Many products sold by AMHG Works LLC may be handcrafted, hand-finished, artisan-made, or produced using natural materials. Variations in color, texture, pattern, wood grain, finish, shape, distressing, stitching, and other characteristics may occur and are considered part of the unique nature of the product.
Such variations do not automatically constitute a defect and do not alone create a right to cancellation, refund, or replacement.
5. Orders and Acceptance
Your submission of an order does not guarantee acceptance. We reserve the right to accept, reject, limit, or cancel any order at our sole discretion, including for reasons involving:
- product unavailability
- errors in pricing or product information
- suspected fraud or unauthorized activity
- billing or payment issues
- shipping limitations
- violations of these Terms
If an order is canceled after payment has been submitted, we will issue a refund as appropriate under our posted policies and applicable law.
6. Pricing and Payment
All prices are subject to change without notice. We strive to display accurate pricing, but errors may occur. In the event of a pricing error, we reserve the right to cancel or refuse any order placed at the incorrect price.
You agree to provide current, complete, and accurate billing and payment information for all purchases. By submitting payment information, you represent that you are authorized to use the designated payment method.
Payments may be processed through third-party payment providers, and your use of those providers may also be subject to their separate terms and privacy practices.
7. Shipping and Fulfillment
We will make reasonable efforts to ship orders within the timeframe stated at checkout or otherwise communicated. Under the FTC’s Mail, Internet, or Telephone Order Merchandise Rule, sellers must have a reasonable basis for any shipment claim they make, and if no shipping time is stated, they generally must have a reasonable basis to believe they can ship within 30 days.
If we cannot ship within the promised time, or within the applicable baseline period when no shipment time is stated, we may contact you to request your consent to a delay or issue a refund for unshipped merchandise as required.
Delivery dates are estimates only unless expressly stated otherwise. We are not liable for delays caused by carriers, weather, supply disruptions, or events beyond our reasonable control.
8. Returns, Refunds, and Cancellations
All returns, refunds, exchanges, store credits, and cancellations are governed by our posted Refunds and Returns Policy, which is incorporated into these Terms by reference.
We reserve the right to deny returns or refunds that do not comply with that policy. Nothing in these Terms is intended to override any rights that may apply under applicable consumer protection law for defective or misrepresented goods. Maine’s consumer guidance notes that a seller generally cannot rely on a “no refund” policy to avoid responsibility for defective goods that violate a warranty.
9. American-Made and Product Origin Statements
AMHG Works LLC may describe certain products as American-made, made in the USA, crafted in the USA, assembled in the USA, or similar. Any such statements apply only to the specific products for which they are made.
We rely in part on information provided by suppliers, makers, and manufacturers, and we reserve the right to revise product-origin descriptions if supply chain information changes or is corrected.
Unqualified “Made in USA” claims are subject to FTC standards that generally require final assembly or processing in the United States, all significant processing in the United States, and that all or virtually all significant components or ingredients are made and sourced in the United States.
10. Acceptable Use
You agree not to use our online services:
- for any unlawful purpose
- to violate any applicable law or regulation
- to infringe the intellectual property or other rights of any person or entity
- to transmit harmful code, malware, or disruptive material
- to interfere with or disrupt the operation or security of our services
- to attempt unauthorized access to accounts, systems, or data
- to scrape, copy, reproduce, republish, or exploit our content for commercial purposes without written permission
- to submit false, misleading, or fraudulent information
We reserve the right to suspend or terminate access for conduct that violates these Terms or otherwise threatens our business, customers, or systems.
11. Intellectual Property
All content made available by AMHG Works LLC, including but not limited to text, graphics, logos, product photos, designs, page layouts, branding, compilations, and other materials, is owned by or licensed to AMHG Works LLC and is protected by applicable intellectual property laws.
You may use our online services only for personal, non-commercial use unless we provide prior written permission otherwise. No license or ownership interest is transferred to you by your use of our services.
12. User Submissions
If you submit reviews, comments, messages, photos, testimonials, suggestions, or other materials to us, you represent that you have the right to provide that content and that it does not violate the rights of any third party.
By submitting content, you grant AMHG Works LLC a non-exclusive, royalty-free, transferable, sublicensable right to use, reproduce, modify, publish, display, and distribute that content in connection with our business, subject to applicable law.
We reserve the right, but not the obligation, to remove or refuse any content we believe is unlawful, misleading, abusive, defamatory, infringing, spam-like, or otherwise inappropriate.
13. Third-Party Services and Links
Our online services may contain links to or integrations with third-party websites, payment providers, social platforms, shipping providers, or other services. We do not control and are not responsible for the content, policies, availability, or practices of those third parties.
Your use of third-party services may be governed by separate terms and policies.
14. Disclaimer of Warranties
To the fullest extent permitted by law, our online services, products, and content are provided on an “as is” and “as available” basis unless otherwise expressly stated in writing.
AMHG Works LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, except to the extent such warranties cannot be lawfully disclaimed.
15. Limitation of Liability
To the fullest extent permitted by law, AMHG Works LLC and its owners, managers, employees, contractors, affiliates, service providers, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to:
- your use of or inability to use our services
- product availability issues
- pricing errors
- shipping delays
- third-party services
- unauthorized access to data
- interruptions, bugs, or technical issues
- reliance on product descriptions or site content
In any event, to the fullest extent permitted by law, the total liability of AMHG Works LLC for any claim relating to a purchase or use of our services shall not exceed the amount paid by you for the product or service giving rise to the claim.
16. Indemnification
You agree to defend, indemnify, and hold harmless AMHG Works LLC and its owners, officers, employees, contractors, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your breach of these Terms
- your misuse of our services
- your violation of any law or third-party right
- your submitted content or conduct
17. Privacy
Your use of our services is also subject to our posted Privacy Policy, which is incorporated into these Terms by reference.
18. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Maine, without regard to its conflict of law principles.
19. Dispute Resolution
Any dispute arising out of or relating to these Terms, your use of our services, or any purchase from AMHG Works LLC shall first be addressed through a good-faith effort to resolve the matter informally by contacting us.
If informal resolution is not successful, any legal action shall be brought in a court of competent jurisdiction located in the State of Maine, unless applicable law requires otherwise.
20. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
21. Entire Agreement
These Terms of Use, together with our posted Privacy Policy, Refunds and Returns Policy, and Disclaimer, constitute the entire agreement between you and AMHG Works LLC regarding your use of our services and purchases from us.
